PAYMENT
Payment is due at the time of presentation of invoice. Unless otherwise agreed a deposit of 50% of the estimated cost shall be required before work commences,35% during and the balance shall be payable on completion of Services. Estimates are based on access provided and may change in the light of unforeseen circumstances, such as problems hidden in the fabric of a building. An estimate should be considered to be an indication of minimum cost based on time and materials anticipated. Unless a fixed price is agreed in writing all work is provided on a time and materials basis at our then current hourly rates. All prices are exclusive of VAT. Any unpaid invoices shall carry interest at the rate of 2% above Bank of England Base Rate on a monthly basis until payment is received in full. Any costs incurred by us in collecting unpaid debts shall also be your responsibility. If you cancel your instructions prior to any work being commenced then we shall be entitled to make a charge for any materials purchased and a reasonable fee for the actual time and inconvenience caused by the withdrawal of instructions.
INSPECTION
You will inspect any works carried out as far as is possible immediately on completion and if you consider any work to be not in accordance with the contract or in any other way substandard, you will give detailed notice of any complaint within seven days of the provision of the Services. In the absence of any such notice the work shall be consider accepted by you.
ACCESS AND INDEMNITY
You will provide clear access to the site where works are to take place and will make all necessary arrangements with the proper authorities for any traffic controls or other permits or authorisations required from third parties for the work to take place. You will ensure that the site is a safe environment for the works to take place and will indemnify ANTON CROSS HSHOMES against any loss or damage caused by your failure to comply with the terms hereof.
CHILDREN AND PETS
Children and pets should be kept well away from any work areas. Delays and interruptions caused by either may be chargeable.
ABUSIVE BEHAVIOUR
We take any form of abuse or assault against any member of our staff very seriously and such actions will not be tolerated. Any such behaviour may result in suspension of work and/or prosecution.
WARRANTY
Anton Cross HSHOMES warrants that it will provide all Services using skill and care and will use all reasonable endeavours to ensure that it will attend at the time and on the date agreed. Other than the foregoing, ANTON CROSS HSHOMES makes no representations or warranties in connection with this Website, or as to the nature, standard, suitability or otherwise of any Services offered by us, whether express or implied, including but not limited to warranties of satisfactory quality, non-infringement or fitness for a particular purpose, except where such warranties are not legally excludable. We are registered as an NICEIC Approved Contractor, with the additional benefits of an Insurance-Backed Warranty under their Domestic Installer Scheme, where applicable.
EXCLUSIONS OF LIABILITY
ANTON CROSS HSHOMES will not be liable for loss or damages of any kind incurred as a result of the Services or the Website other than where directly caused by our negligence or any events beyond ANTON CROSS HSHOMES’s reasonable control. Furthermore, to the fullest extent permitted by law we will not be liable for any direct, indirect, special, incidental, consequential or other damages of any kind related to your use of the Website or the Services and in no event shall our maximum aggregate liability exceed one hundred pounds sterling.

The Company can only be held liable for the extent of works carried out by The Company. No liability shall be accepted in respect of defects in existing installations or in respect of parts not manufactured by The Company. The Company shall not be held responsible for any loss or damage to property, materials or injuries to individuals caused by the personal actions of the customer or other household members or guests before, during or after such works have been carried out.


All advice provided by The Company is offered as an opinion only and the customer accepts such opinions at their sole discretion and risk. The customer employs the services of The Company at his or her sole risk at all times.


Time shall not be of the essence in the performance of any Services and we accept no liability for any delay to estimated start dates or for unforeseen changes due to illness, weather, non-availability of materials or other matters outside our control.


Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of ANTON CROSS HSHOMES or fraud. These disclaimers and exclusions shall be governed by English law. If any provisions of these disclaimers and exclusions are deemed to be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
